Lock Her Up

“Who Are We?” I asked Sunday at Townhall.com.

Today’s question: What have we come to?

Under a seemingly click-bait headline in The Atlantic, “Can Government Officials Have You Arrested for Speaking to Them?” Garrett Epps examines last week’s outrageous handcuffing and arrest of a Louisiana teacher, Deyshia Hargrave, for speech displeasing to the Vermilion Parish school board at a public meeting.

The elementary school teacher complained about a $30,000 raise the board was giving the superintendent, noting that teachers had not seen an increase in nearly a decade. After asserting that the raise would be “basically taken out of the pockets of teachers,” she was ruled out of order by the school board president and then asked to leave the premises. She calmly left the meeting room . . . only to be forced to the floor, handcuffed and arrested once in the hallway.

Police claimed the arrest was for “remaining after having been forbidden” and “resisting an officer.”

The school district announced it won’t press charges. Very funny. Anyone can see from the video that her treatment was excessive.

Next month, the U.S. Supreme Court will hear oral arguments in Lozman v. Riviera Beach, Florida, where an arrest was clearly retaliatory, but the city is newly claiming another violation it could have used to arrest Mr. Lozman.

Does this after-the-fact adding on of charges provide governments with an escape clause? As Epps argues, a Lozman decision “could either rein in, or embolden, the tiny-handed tyrants who rule county buildings and city halls around the country.”

If respectfully challenging our so-called public servants in meetings designed for that can lead to being arrested, handcuffed and dragged off, we no longer live in ‘the land of the free.’

Your Local Vortex of Despair

I don’t know about you, but through the years I’ve received my share of traffic tickets and parking citations. Minor stuff overall, seventy dollars here, a hundred bucks there, a couple hundred smackeroos if caught in the wrong speed trap.

Sometimes the cost made me say ouch. But like most folks I just pay the tickets. And try to slow down.

But if you are poor, struggling, climbing the ladder from one of the bottom rungs?

Different story. And a speed trap set up by your local police or the state troopers, then, has a much different punch to it.

Could traffic tickets be instruments of tyranny?

Well, the $150 some of us can pay with a mere wince another simply cannot pay, or can only pay at the expense of a child’s supper, or replacing a balding tire on the car, or . . . worse.

And those who cannot pay, despairingly, often shirk the “duties” they cannot perform. Like coming to court to pay the fines they can’t pay. And then they get arrested. And then serve time.

A few more “and thens” and their lives are wrecked. Along with the lives of their children.

Radley Balko tells several such stories in his recent article, “How municipalities in St. Louis, Mo., profit from poverty.” He explains the very human costs of speed traps and other penny ante scofflaw “services” the police inflict all around Ferguson, the scene of last month’s protests and violence.

Balko quotes one observer, who describes the whole system as a trap for the poor, sucking them into a “vortex of despair.”

Stop punishing the working poor with excessive fines. Vanquish the vortex!

Learning from Sal Grosso

Sal Grosso, a retired man in his 80s, moved to Cape Coral, Florida, after a successful career as a troubleshooter for New York State’s phone network. Since then he has served as troubleshooter for the government of Cape Coral, writing a column, kicking up a fuss.

And boy, does Cape Coral need a troubleshooter! Sal has uncovered a whole network of incompetence and corruption in the water, sewer, and charter school bureaucracies.

After years of trying, he got the state to do an operational audit of the town — which is now under federal investigation.

While preparing a column about him for Townhall.com, I learned about Sal’s methods. He solves problems through a common-sense process he calls “sectionalization.” Start with a problem area, divide it in half. Determine which half holds the problem, focus on it and repeat.

“You keep whittling the problem down until you’ve isolated it,” he says, “to a very manageable size, which enables you to decide on where to look, and what to look for.”

He’s done this with the local water system, the city budget, sewer — you name it.

If you have a knack for problem solving — say, you like puzzles — then why not follow Sal’s example and give your local governments a look? Governments often present huge puzzles. Unravelling the messes that politicians and bureaucrats have made can be very rewarding.

Well, perhaps not so much. But it IS critical in keeping government accountable.
